ILR/ Citizenship (Indefinite Leave to Remain)

1. Indefinite Leave to Remain (ILR)

ILR, also called permanent residency, allows foreign nationals to live and work in the UK without time restrictions. It’s an important step for those wishing to settle in the UK permanently.

Eligibility Criteria for ILR:

Qualifying Period: Applicants usually need to have lived in the UK for five or ten years under a specific visa category, such as work, family, or long-term residency.

Common Routes to ILR:

Work visas: E.g., Tier 2 General, Tier 1

Family visas: Spouse, partner, parent visas

Long-term residency: For those who’ve lived in the UK for an extended period.

Continuous Residence: Applicants must demonstrate they have lived continuously in the UK without significant breaks during the qualifying period.

Financial Requirements: Proof of financial stability may be needed to show the applicant can support themselves and any dependents.

Benefits of ILR:

No Time Restrictions: Once granted ILR, there are no limits on how long the individual can stay in the UK.

Settlement for Dependents: Family members of the primary visa holder can apply for settlement at the same time.

Naturalization: After holding ILR for a period, individuals can apply for British citizenship.

Access to Public Funds: ILR holders are eligible for public funds and healthcare services through the NHS.

Application Process:

•Complete an application form and provide supporting documents (e.g., proof of residence, financial stability).

•Some applicants may need to take the Life in the UK Test, which tests knowledge of British history, culture, and customs.

2. British Citizenship

Applying for British citizenship is the next step after holding ILR for a specified period. It allows full integration into British society, including the right to vote and apply for a British passport.

Eligibility Criteria for British Citizenship:

Residence Requirements:

•Applicants must have lived in the UK for five years if married to or in a civil partnership with a British citizen.

•Otherwise, applicants need to have held ILR for at least one year before applying.
